Under the Domestic Violence Act, various reliefs can be provided to victims of domestic abuse. Our legal team is experienced in securing these reliefs for clients to ensure their safety and dignity are upheld during the legal process. These reliefs include:
A protection order can be issued by the court to prohibit the abuser from committing any further acts of domestic violence. This order can prevent the abuser from entering the victim’s residence or coming into contact with the victim.
A residence order allows the victim to continue living in the shared household or to secure a separate residence. The court can order the abuser to provide alternate accommodation if the victim is unable to continue living in the shared home due to violence.
The court can grant monetary relief to the victim for the losses and damages suffered due to domestic violence. This includes compensation for physical harm, emotional distress, medical expenses, loss of earnings, and the costs involved in the legal proceedings.
If children are involved, the court can issue orders related to custody and visitation rights. The primary concern is the child’s well-being, and the court will ensure that the child is placed in a safe environment.
In addition to monetary reliefs, the Domestic Violence Act allows the court to grant interim reliefs to the victim, such as financial assistance for medical treatment, daily sustenance, or urgent housing needs.
The court may order counseling for the abuser to prevent future violence. Victims may also be offered rehabilitation and support to help them recover emotionally and financially from the abuse they have suffered.
