Supreme Court Grants Mutual Consent Divorce Using Article 142

In Manav Agarwal v. Nemo (2025), the Delhi High Court held that spouses residing abroad may, in appropriate cases, pursue mutual consent divorce proceedings through duly authorised Special Power of Attorney (SPA) holders and video conferencing. The Court emphasized that neither Section 13B of the Hindu Marriage Act nor the Family Courts Act mandates personal physical appearance in every case, and directed the Family Court to proceed with the second motion petition without insisting on procedural requirements not contemplated by law.
